Blam Academy Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Blam Academy App (the “App”), a service provided by Blam Websites Ltd (“Blam”, “we”, “our”, or “us”). By downloading, accessing, or using the App, you agree to be bound by these Terms and our Acceptable Use Policy. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these conditions.
If you do not agree to these Terms, you must not download, access, or use the App.
1. Eligibility
Blam Academy is a free professional resource for entrepreneurial learning and digital development, available through the App. It is open to any professional or business owner. No paid subscription, invitation, or existing commercial relationship with Blam is required to access the educational content.
2. Account Registration & Security
To access the App, you must register using credentials associated with your authorised Blam business account. You are responsible for:
- Maintaining the confidentiality of your login details and password.
- All activities that occur under your account.
- Promptly notifying Blam at support@blamwebsites.com of any unauthorised use or security breach.
The App is a communication tool; by using it, you consent to receiving notifications regarding platform updates, community news, and professional resources.
3. Privacy & Data Usage
Your use of the App is subject to the Blam Privacy Policy, available at www.blamacademy.co.uk/privacy. You acknowledge that Blam Academy may process personal and business data to facilitate networking, provide, improve, and personalise the App experience. We employ industry-standard security measures to protect your information, but you acknowledge that no digital platform is entirely immune to risk.
4. License Grant & Restrictions
Blam Academy grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for professional and internal business purposes. You may not use its contents to create a competing service or resell access to the platform.
You shall not:
- Sublicense, sell, lease, or rent the App or its contents to third parties.
- Decompile, reverse engineer, or attempt to derive the source code of the App.
- Use the App to build a competitive product or service.
- Use the App for any personal or non-business purposes outside the scope of your authorised business account.
5. Intellectual Property Rights
All rights, titles, and interests in the App—including but not limited to software, training modules, professional resources, brand assets, and proprietary algorithms - remain the exclusive property of Blam Websites Ltd. Nothing in these Terms transfers any ownership of Blam’s intellectual property to you.
6. User Content & Conduct
You retain ownership of any original content you upload or share via the App (e.g., posts, comments, and resources). However, you grant Blam a non-exclusive, royalty-free, worldwide license to host, use, and display such content within the App for the purpose of providing services and for community-building purposes.
Prohibited Activities:
- Uploading content that is defamatory, illegal, or infringes upon third-party intellectual property.
- Violating laws or third-party rights.
- Disrupting the App’s functionality.
- Posting illegal or offensive content.
- Using automated tools (bots, scrapers) to extract data from the App, including scraping data without written consent.
7. Data Protection (GDPR)
Both parties agree to comply with all applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Where you process customer data via the App, you represent that you have a valid legal basis for such processing. Blam Academy will process data in accordance with our role as a service provider and will not disclose your customer data to third parties except as required by law or as necessary to provide the service.
8. Limitation of Liability
To the maximum extent permitted by law, Blam Websites Ltd shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of data, or business interruption, arising out of or in connection with your use of the App. As this App is provided free of charge, our total liability for any claim arising under these Terms shall not exceed £100.
9. Indemnification
You agree to indemnify and hold harmless Blam Websites Ltd and its directors, officers, and employees from any claims, damages, or legal fees resulting from your breach of these Terms or your misuse of the App.
10. Termination
We may suspend or terminate your access at our discretion, particularly if you no longer meet the account eligibility criteria or if you breach these Terms. We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, if:
- You breach these Terms.
- Your account is no longer active or authorised.
- We cease to offer the App service.
Upon termination, all licenses granted herein shall immediately expire.
11. Confidentiality
The App contains proprietary professional resources and strategy. You must keep this information confidential and not share it with unauthorised third parties.
12. Brand Protection
Users may identify as part of the "Blam Academy" but must not imply they are an employee or owner of Blam Websites Ltd. All Blam trademarks remain our exclusive property.
13. Community Conduct & Non-Solicitation
To maintain a supportive environment, you agree not to solicit employees or clients from other users discovered through the App. Harassment of other users will result in immediate removal.
14. Governing Law & Jurisdiction
These Terms and any disputes arising out of them shall be governed by and construed in accordance with the laws of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim.
15. Amendments
Blam may update these Terms from time to time to reflect changes in the law or our services. We will notify you of significant changes by posting the updated "Last Updated" date at the top of this document. Continued use of the App following such changes constitutes your acceptance of the new Terms.
